I get what you're saying. My point is that the Sherman Act (of 1890) is not what needs to be changed. It's the McCarron-Ferguson Act of 1945 that exempts much of the insurance companies from the Sherman Act. And a resolution was introduced this year to change that exemption. Support

Any plan that is self funded, i.e. the dental insurance company processes the claims, but ultimately sends the bill to the employer, are covered under federal ERISA law.
