Andover, MA - September 26, 2014 - Neodent USA, Inc. (to be known as Instradent USA, Inc. from October 1, 2014) has responded to Nobel Biocare’s allegations of patent infringement filed in August in the Central District of California and related to one of its dental implants.

In addition, Instradent has filed counterclaims against Nobel Biocare, which challenge the validity of the patents in question.

The counterclaims are based on strong evidence that will show the relevant authorities that the history of Patent 8,714,977 contains particularities, including limitations that were introduced at a later stage. On the basis of this and other evidence, Instradent claims that the patents were erroneously granted and should be invalidated. The counterclaim also includes a demand for declaratory judgment of non-infringement.

Tony Susino, CEO of Instradent USA commented: “Instradent is committed to observing valid patent rights. We are convinced that we have not infringed Nobel Biocare’s patents and have a strong claim that challenges their validity. In spite of this case, Instradent remains steadfast in delivering high quality, attractively-priced solutions to meet its customer and patient needs.”
