Synopsis:
This course will educate you on the definition of the Standard of Care as how to meet it as well as Key legal terms you need to know. Guidelines are given for what is looked for in dental board cases and malpractice cases and local anesthetic and sedation mistakes dentists make. Examples of lines that should not be crossed and typical treatment notes you should incorporate into practice. You will also receive a template developed for the Arizona State Board of Dental Examiners that is used to help define appropriateness of care.

Furthermore, you will learn about cases that involved adverse outcomes (death cases) and how to prevent that from happening to you. You will be given Proposed Standard of Care examples as well as difficult case dilemmas and what you should do given your skill, knowledge, and learning abilities.


Educational Objectives:
Upon completion of this course, you should be able to:

  • Recognize the two landmark cases that helped define the Standard of Care in Dentistry
  • Understand legal terms including “Comparative Fault, Causation, and Loss of Chance”
  • Understand the typical treatment notes you should have in your chart.
  • Recognize the top 11 mistakes dentists make during oral conscious sedation.
  • Recognize the top 10 mistakes dentists make at a permit evaluation
  • Be able to recognize lines that should not be crossed in dentistry
Description of Speaker:
Dr. Dovgan has been an Arizona State Board of Dental Examiners Consultant for over 20 years, adjudicating over 1,000 cases. He has also been a 1303 permit examiner for the State of Arizona for over 5 years and a dental expert witness for over 100 cases throughout the United States.

Dr. Dovgan has been Governor approved as a dental defense expert witness for the State of Arizona on its class action lawsuit (Parsons v. Ryan). This lawsuit was the largest lawsuit the State of Arizona has ever had against it since the water rights lawsuit when the Hoover dam was built. This lawsuit involved over 85,000 pages of documents for just the dental portion.

Dr. Dovgan also was retained by the State of Michigan and approved by the Attorney General as their dental defense expert on their class action lawsuit (Johannes v. Heyns) as well as representing the defense on a Federal Civil Lawsuit in the State of Illinois (Smego v. Mitchell).

He has been a dental defense expert witness for the 6th, 7th, and 9th district courts as a Standard of Care expert. Dr. Dovgan has had the privilege to examine over 10,000 patient dental charts throughout the United States, which gives him the unique understanding of the Standard of Care.

Furthermore, Dr. Dovgan has assisted in setting case law in three separate landmark cases as well as being instrumental in changing your business insurance policies to now include ordinance of law clause that previous policies did not have.

Lastly, Dr. Dovgan developed the only board approved template for the State of Arizona used as a guideline to access appropriateness of care.
