"Must Do" HR Compliance Checklist Series:
Part 1

HIRING
It is important to conduct a regular review of
your HR (human resources) procedures to ensure compliance with the
law and
prevent employee lawsuits. The checklist below features key
steps for evaluating your management practices.
- Job descriptions, advertisements, and interviews that are state and federal compliant
- Review your employment applications to ensure compliance with state and federal law
- All interview questions must be appropriate and relate directly to the position and the applicant's ability to perform the job's essential functions. Questions should never relate to race, sex, religion, age, ethnic group, national origin, marital status, military service, disability or other protected status.
- Written authorization must be obtained for background checks
- Policies and procedures that relate to drug testing, use of arrest and conviction records, and other candidate-information requests must comply with applicable federal and state law.
- Evaluate all recruitment and hiring strategies, policies, and procedures to ensure compliance with federal and state law.
- Job offer letters should be reviewed by an employment law attorney
- Forms I-9 should be completed for all new employees within 3 business days from the date of hire
- Make sure all new hire reporting requirements are satisfied and necessary tax forms (Form W-4 and any required state forms) are obtained from new employees.
- Review your orientation program for new employees
